General Terms and Conditions of Contract / Sale
1. Object and scope of application
These General Terms and Conditions of Sale (hereinafter, the “Terms”) govern the contractual relationship between AlmAmericas and the User who purchases products through the Website www.almamericas.com (hereinafter, the “Client”).
Purchasing products through the Website implies full and unreserved acceptance of these Conditions, which the Customer declares to have read and understood before placing the order.
These Terms and Conditions apply to orders placed from Spain and the European Union .

AlmAmericas strives to ensure the information is accurate, although colors, textures, and appearance may vary slightly depending on the device's screen or the handcrafted nature of each piece.
4. Purchase process

The customer selects the products they wish to purchase and adds them to the cart.

Once the products have been selected, the Customer accesses the shopping cart, where an order summary will be displayed, including shipping costs and total amount to pay.

The Customer must provide the personal data necessary for processing the order and delivery.

The Customer will select the available payment method and expressly accept these Terms and Conditions and the Privacy Policy.

Once payment is complete, the Customer will receive a confirmation email with the order summary. The sales contract will be considered finalized at that time.
The Customer agrees to provide truthful and complete information. AlmAmericas is not responsible for delays or delivery failures resulting from incorrect or incomplete information.
5. Prices and taxes
Product prices are shown in euros (€) and include applicable taxes (VAT) , unless expressly stated otherwise.
Shipping costs will be clearly displayed before the Customer confirms their order.

Standard shipping cost for mainland Spain: €6.90

Free shipping: for orders equal to or greater than €50 delivered to mainland Spain.
For shipments to other EU territories, shipping costs will be calculated and displayed before you finalize your purchase.
AlmAmericas reserves the right to modify prices at any time, but orders will be billed at the price in effect at the time of confirmation by the Customer.
6. Payment methods

AlmAmericas does not store complete credit or debit card data under any circumstances; this data is managed directly by the corresponding payment gateways.
7. Shipping and delivery times

The estimated delivery times are:

Spain: between 48 and 72 working hours from order confirmation and preparation.

European Union: between 3 and 7 working days , depending on the destination country.
These deadlines are indicative and may be affected by circumstances beyond AlmAmericas' control (strikes, weather conditions, periods of high demand, etc.).
The risk of loss or damage to the products is transferred to the Customer at the time of delivery of the order to the address indicated.
If delivery is not possible due to the recipient's absence or incorrect information, the shipping company will contact the customer according to its own procedures. Any costs incurred for redelivery or second deliveries may be charged to the customer.
8. Right of withdrawal
In accordance with consumer and user regulations, the Customer has a period of 14 calendar days from receipt of the order to exercise their right of withdrawal, without needing to state a reason.
However, there are legal exceptions to the right of withdrawal , including:

Sealed food products that cannot be returned for health protection or hygiene reasons and that have been unsealed after delivery.

Products made to the consumer's specifications or clearly personalized.
In the case of AlmAmericas:

Coffee and chocolate: returns are accepted only if the packaging is unopened, unsealed and in perfect condition , within 14 days of receipt.

Handcrafted products: returns are accepted within 14 calendar days of receipt, provided the product is in perfect condition. If the product arrives damaged or defective, we recommend notifying us within the first 48 hours of receipt so we can handle the issue more efficiently.
How to exercise the right of withdrawal:
The Customer must communicate their decision to withdraw from the contract by means of an unequivocal statement (for example, an email) sent to:

AlmAmericas may provide an optional withdrawal form if requested by the Customer.
9. Return and refund conditions

Products must be returned in their original condition , unused, with their packaging and complete labeling.

Once the return has been received and the condition of the products has been verified, AlmAmericas will proceed to refund the corresponding amount within a reasonable time, using the same payment method used by the Customer, unless otherwise agreed.

In case of withdrawal by the Customer (without defect or error on the part of AlmAmericas), the Customer will assume the direct costs of return .

If the return is due to an error by AlmAmericas or a damaged/defective product, AlmAmericas will assume the return costs or propose a solution (replacement, voucher, etc.) by mutual agreement with the Customer.
10. Guarantees
The products offered are subject to the legal guarantees of conformity applicable to each type of good. In the case of food products, the guarantee is primarily linked to the best before or expiration date, provided that the storage conditions indicated on the packaging are respected.
For handcrafted products, the legal guarantee of conformity will apply under the terms and deadlines established by current regulations.

12. Modification of the Conditions
AlmAmericas reserves the right to modify these Terms and Conditions at any time. Modifications will not affect orders already placed and confirmed.
13. Applicable law and jurisdiction
These Terms are governed by Spanish law.
In case of conflict, the parties submit to the Courts and Tribunals of Langreo (Asturias) , unless the regulations for the protection of consumers and users establish another mandatory jurisdiction.
